There are enough differences from the original for it to not be plagiarism. This shit happened to the NGNL artist and literally nothing happened and those were pretty much 95% traces.
Fair use does not protect commercial products sold for profit.
And even despite that, tracing is still considered a very serious form of plagiarism. A trace is not an homage or an imitation, it is literally taking someone else's work and presenting it as your own. In this case, someone else's work is being used to sell a product for profit.
There was a stink yes, and I bet that the controversy ruined sales for NGNL and the artist and even his rep. But that is it. His traced artwork was deemed to be different enough (literally only had a different face drawn) that it didn't breach anything.

A court would have deemed it that. It didn't go to court because the owners of the traced material chose not to pursue it. Plagiarism is a civil case, not a criminal one. He got away with it because the people he stole from chose not to litigate.

I really liked Worlds. It was a massive U-turn from his earlier stuff and his use of vocaloid was fantastic. English vocaloid is so tricky to make sound unrobotic. And the lyrics for most of his songs were straight out of a JRPG. It was very nice.

Actually, sampling WAS popularized by groups like The Beatles and Frank Zappa & The Mother of Invention. You need to listen to more rock music, there's plenty of sampling in a whole bunch of Prog and Avant Rock records from the late 60's/70's.

I'd also submit that "popularized" is a pretty broad term. Among musicians, it was certainly popularized by The Beatles and Zappa. Plenty of bands imitated them, hence "popularizing" sampling.

I am a music major with a very good grasp on time periods, and rap is what "POPULARIZED" sampling.
OK, I'll spell it out for you.
Using a photograph as a reference is called making a "derivative work". Derivative works may or may not be covered under fair use terms, depending on the country and whether or not the derivative work is made for profit. In the case of a professional artists making a derivative work, that is clearly done for profit and so most countries' fair use laws (even if they have such laws) will not apply and so it's a copyright violation.
Making any image of something that is trademarked is a trademark violation. If the likenesses of players in some sports have been registered as trademarks then however you depict them, you are violating a trademark and can be sued or prosecuted, depending on which country's laws apply.

The NGNL accusations used compositions with multiple pictures, changed angles and it often was about just parts of the drawing. Now, it does seem likely that he uses bases for those pictures, but by the time you need to do all that composition to find the original source it isn't just "tracing" anymore.
